Google Gemini feels safe. It is Google, after all. Everyone uses Google. So Gemini should be fine too, right?
That reasoning comes up constantly in forums, LinkedIn threads, industry groups. And it is wrong. Not because Google builds a bad product. Because GDPR requirements for AI tools do not depend on how familiar the brand name sounds.
Gemini has a few quirks that set it apart from other AI tools. Not in answer quality. In what happens to your data after you type it in.
The 72-hour trap
This is the part almost nobody knows. Gemini offers a setting to turn prompt storage off. Sounds good. Go ahead, turn it off.
Problem solved? No. Even with storage disabled, Google keeps your inputs for 72 hours. Three full days. Google cites “safety and abuse review” as the reason. During those 72 hours, human reviewers at Google can access your prompts.
Picture this: an employee at your firm enters a client query into Gemini. Personal data, name, tax ID, case details. Even with storage turned off, that data sits on Google servers for three days. Accessible to human reviewers.
For regulated businesses, that is not workable. You have no control over retention. You have no control over who sees the data. And you have no contract governing any of it.
18 months of storage by default
It gets worse. The 72-hour trap applies to users who actively disable storage. The default setting is different.
If you change nothing (and most people change nothing), your prompts are stored for 18 months. Every input. Every question. Every client name that accidentally ends up in a prompt.
I have never seen a firm where every employee actively configures their Google settings. The reality: someone opens Gemini in their browser, types a question, gets an answer. Takes 30 seconds. The data stays for 18 months.
Consumer version: no DPA
This is the core issue. The consumer version of Gemini, the one anyone can access through their Google account, does not offer a Data Processing Agreement.
Without a DPA, you are missing the contractual basis required by Article 28 GDPR. This is not a grey area. It is settled law. If your employees enter personal data into consumer Gemini, you have no contractual framework for that processing.
No DPA also means: no contractual commitments on data deletion, no defined technical and organizational measures, no audit rights. You are sending data to a processor without any contract governing what happens to it.
Consumer vs. Workspace Enterprise
Google does offer a GDPR-capable version. Gemini in Google Workspace Enterprise comes with a DPA, no training on your data, and EU data residency.
The problem: most employees are not using that version. They use the consumer version. Through their personal Google account. Or through a Google account they set up for work that is not part of the Workspace Enterprise license.
From the outside, the difference is invisible. Gemini looks the same either way. Same interface. Same URL. But the GDPR conditions are completely different.

How Gemini compares to Copilot
Microsoft Copilot for Microsoft 365 has its own issues. Oversharing, the Anthropic subprocessor situation, the German data protection authorities’ assessment. But on one point, Microsoft is further along: there is a DPA, an EU Data Boundary, and contractual commitments that apply to all business licenses.
Google Gemini has those too. But only for Workspace Enterprise. The consumer version stands bare. No DPA, no EU data residency, 72-hour retention even with storage disabled, 18 months by default.
When an employee opens google.com on their work laptop and uses Gemini, they are in consumer territory. Not enterprise territory. And most companies do not realize it.
What to do now
Three steps. None of them are complicated.
First: Check which Google licenses are active in your organization. Do you have Google Workspace Enterprise with the Gemini add-on? Or are your employees using consumer accounts?
Second: If employees use the consumer version, add Gemini Consumer to your AI acceptable use policy as a blocked tool. Not a suggestion. A clear rule: no personal data goes in there. Third: If you run Google Workspace Enterprise and want to enable Gemini, check the configuration. DPA signed? EU data residency enabled? Training disabled? The option for GDPR-compliant use exists. But it has to be configured.
Not a ban. A boundary.
I am not saying Gemini is bad. Gemini is a capable tool. In the enterprise version with the right settings, it can be used in a GDPR-compliant way.
But the consumer version is not suitable for business use with personal data. That is not a judgment on the technology. It is a statement about the contractual and regulatory framework.
And the 72-hour trap shows that even the settings Google provides do not go as far as most people assume. “Storage off” does not mean “data gone.” It means: still there for three days, with human access.
